Terms and Conditions
These terms and conditions apply to all orders placed. Please read all information carefully. By placing an order with us you are accepting the terms and conditions set out herein. 1. Parties
1.1 – “Conditions” means the terms and conditions set out in the document.
1.2 – “Product’ means any Product supplied by Carestore in accordance with these conditions.
1.3 “ROI” means Republic of Ireland.
1.4 “Ni” means Northern Ireland,
1.5 “UK’ means Scotland, Wales & England.
1.6 “We/Us” means Carestore and “Our” shall be construed accordingly.
1.7 “You/Your” means any person ordering Products from Carestore.

1.9 “Fax” means contact by facsimile number 065 689 0022
1.10 “Telephone” means contact by telephone number 065 689 0011
1.11 “Working Days” means Monday to Friday excluding Bank Holidays or Public Holidays.
1.12 “Opening Hours” means Monday to Friday 9.30am to 6.00pm. Saturday 10am to 3pm.
2. Payment
2.1 All payment must be made at point of ordering product and are made subject to acceptance by ‘You’ of ‘Our’ terms and conditions. Fulfillment of the order is subject to stock availability and acceptance of ‘Your’ order by ‘Us’ and ‘We’ are under no obligation to fulfill ‘Your’ order.
2.2 Payments can be made using most major credit cards or using PayPal.
2.3 ‘We’ reserve the right to apply a charge of 9% of value of invoice per month for any failed payment by ‘You’ to ‘Us’ for any product or service. The charge will apply to the full invoice value including carriage value.
2.4 If ‘You’ experience any ordering difficulties or have any concerns please contact us immediately by telephone, fax or e-mail. Please note ‘Our’ business opening hours in section.
3. Price
3.1 Prices shown by ‘Us’ are accurate on the date that they were published and are subject to change.
3.2 ‘We’ reserve the right to apply or remove special prices or to discount prices on Product based during promotional periods or on a ‘while stocks last’ basis.
3.3 ‘We’ reserve the right to vary the price of the Product to take account of any increases in the cost of raw materials, manufacture, packing, transport, wages or otherwise.
4. Currency
4.1 All prices quoted on the site will be quoted in Euro and when currency option is selected on the site Sterling Pounds can be illustrated. The currency exchange rate will be preset by ‘Us’ and may differ from the currency exchange rate on date and time of ordering by ‘You’.
4.2 ‘We’ will not refund any difference in rates to ‘You’.
4.3 In any refund or credit or refund by ‘Us’ to ‘You’ (see section 10); Currency exchange rates set by us will apply on date of credit or refund processing.
5. Delivery
5.1 Standard time scales for delivery of Product to ‘ROI’ addresses by a nominated carrier chosen by ‘Us’ are as follows;
5.2 Stocked products 2-3 working days.
5.3 Non-stocked product will be reliant on manufacturing lead time. ‘You’ are advised to contact ‘Us” prior to ordering to obtain a forecast delivery date. This will be re-confirmed by ‘Us’ when an order is processed.
5.4 Standard time scales for delivery of Product to ‘Ni’ addresses by a nominated carrier chosen by ‘Us’ are as stated in 5.2 & 5.3
5.5 Standard time scales for delivery of product to ‘UK’ addresses by a nominated carrier chosen by ‘Us’ are as follows;
5.6 Stocked product 2-4 working days.
5.7 Non-stocked product as per 5.3
5.8 ‘Your’ contact telephone number for delivery must be provided on all orders.
5.9 ‘We’ will not be liable for late delivery of Product and time shall not be of the essence in these Conditions and ‘We’ reserve the right to make partial deliveries.

5.11 ‘We’ reserve the right to increase this delivery charge where such an increase is beyond ‘Our’ control. Contact ‘Us’ if you have any special delivery requirements in advance of dispatch of Product.
6. Cancellation procedure for Consumers.
6.1 ‘You’ have the right to cancel an order except for made to measure Product within seven working days of receipt of Product(s) provided that the Product(s) is not damaged, opened and removed from packaging or used.
6.2 All cancellations must be made in writing to ‘Us’ detailing the reason for return. This detail must be received at ‘Our’ address within the seven days cooling off period.
6.3 I f ‘You’ do cancel within seven days and in full accordance with the procedure stated in 6.2 then ‘You’ will be entitled to a full refund by ‘Us’ of all monies debited by ‘Us’ within thirty days of the date the notice of cancellation was given together with the reasonable costs to ‘You’ of the safe return of the Product(s) provided such return is a result of the Product(s) being defective.
6.4 If ‘You’ cancel ‘Your’ order but do not comply with clause 6.2 then ‘You’ will be entitled to a refund of the cost of the Product(s) minus the cost of ‘Us’ to collect the Product(s) from ‘You’.
7. Passing of title
7.1 The legal title of the Product(s) shall not pass to ‘You’ until all sums due payable by ‘You’ the customer to ‘Us’ have been paid in full.
8. Warranty
8.1 Unless otherwise stated, a twelve month guarantee applies to all Product with the exception of disposable and limited life Product. The warranty is valid providing the Product has been used in accordance with the user instructions. Please retain ‘Your’ original invoice as proof of purchase. The twelve month warranty period commences from date of invoice.
9. Returns
9.1 Except as provided in Clause 6 above relating to consumers all cancellations or arrangements for the return of Product are at ‘Your’ own cost.
9.2 If ‘You’ receive Product that is defective please contact ‘Us’ by e-mail, Fax or Telephone within seven days of receipt of Product. In this case ‘You’ will be entitled to a refund from ‘Us’ limited to the cost of repair or (where appropriate in ‘Our’ opinion) replacement of the Product.
9.3 If ‘You’ wish to return Product please contact ‘Us’ by e-mail, Fax or Telephone stating the reason for return. ‘We’ will then provide ‘You’ with a returns instruction for ‘You’ to complete and return with the appropriately packaged Product.
9.4 If you comply with clause 6.3 ‘We’ will refund ‘You’ all monies debited by ‘Us’.
9.5 If ‘You’ do not return the Product in accordance with clause 6.3 ‘We’ will be entitled to deduct the charge from monies owed to ‘You’ fro the cost of ‘Us’ recovering such Product.
9.6 Where Product is returned for Credit ‘We’ will be entitled to incur the following restocking fees; Within seven days – NONE, 7-14 days 20%, 14-21 days 40%, 21 days to six months 60% and over twelve months 100%.
10. Refunds
10.1 If ‘You’ feel that ‘You’ have been incorrectly charged for the Product that ‘You’ have ordered or that ‘Your’ original order (except where it has been agreed in advance by ‘You’ and ‘Us’) please contact us by e-mail, Fax or Telephone.
10.2 If ‘You’ comply with clause 6.1 ‘You’ will be entitled to a full refund of incorrect amounts debited to ‘Us’ or all monies debited by ‘Us’ should ‘You’ cancel the order within 30 days receipt by ‘Us’ of your complaint.
11. Liability
11.1 In relation to the purchase of Product ‘We’ accept no liability for indirect or consequential loss or damage or for any loss of data, profit or revenue or business (whether direct or indirect) however caused.
11.2 ‘We’ accept no liability for the loss however caused whether due to the inaccuracy, error, omission or any other cause or whether on ‘Our’ part or that of ‘Our’ servants, agents or any other person.
12. Jurisdiction.
12.1 The conditions shall be governed by and construed in accordance with the laws of the Republic of Ireland and ‘You’ irrevocably submit to the exclusive jurisdiction of the courts of the Republic of Ireland.
13. Force Majeure.
13.1 ‘We’ shall not be liable to ‘You’ where performance of any of ‘Our’ obligations to ‘You’ is prevented by any Act of God, war and other hostilities, civil commotion, accident, strikes, lock outs, trade disputes, acts or restraints of Government or any other cause that is not reasonably within ‘Our’ control.
14. Severance.
14.1 If any part of the Conditions shall be deemed unlawful, void or if any reason unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not effect the validity and enforceability of any of the remaining provisions of the Conditions.
15. Waiver.
15.1 No waiver by ‘Us’ of any provision of the Conditions shall be construed as a waiver of any proceeding, succeeding or continuing breach of any provision of the Conditions.
16. Entire Agreement.
16.1 These Conditions govern ‘Our’ relationship with ‘You’. Any changes to these Conditions must be in writing and signed by both parties. ‘You’ confirm that in agreeing to accept Conditions ‘You’ have not relied on any representation save insofar as the same has expressly been made a term of these Conditions and ‘You’ agree that ‘You’ shall have no remedy in respect of any representation.
17. Statutory Rights.
17.1 Where ‘You’ are a consumer ‘Your’ statutory rights are not affected by these Conditions.
